Proposed Constitutional Amendments | 2025

The following amendments are proposed in accordance with Article XI, Section 2, of the Post 307 Constitution. 


All proposed changes are highlighted in RED


AUTHORITY TO MAKE AMENDMENTS


Article XI, Section 2

Section 2. This constitution may be amended at any regular post meeting by a vote of two-thirds of members of said post attending such regular meeting, provided that the proposed amendment shall have been submitted in writing and read at the next preceding regular meeting of said post, and providing further that written notice shall have been mailed to all members at least Ten (10) days in advance of the date when such amendment is to be voted upon, notifying said members that at such meeting a proposal to amend the constitution is to be voted upon.

Article IV, Section 2: INSERT ADDITIONAL LANGUAGE

Section 2. Application for membership shall be made in writing under such regulations as may from time to time be prescribed by the post executive committee   using the American Legion membership application form. A prospective member must also submit a DD214, or other acceptable retirement form that appears on the list of the American Legion forms that proves military service.

Article IV, Section 3: STRIKE ENTIRE SECTION

Section 3. All applications for membership shall be acted upon at the next post meeting following the making of such application, and shall, at such meeting, be accepted, rejected or referred for future investigation and consideration. If the majority of members present cast their vote against the acceptance of said application, then such applicant shall be recorded as rejected. A rejected application shall not again be considered until after the expiration of six months from the date of such rejection.


Article IV, Section 3: INSERT NEW SECTION

Section 3. If the prospective member’s application form and DD214 or similar document are acceptable to the Membership Chairman, then the Chairman will inform the Commander and the members in attendance at the post meeting that the credentials are in order. At that point, the applicant is accepted as a new member of Post 307.

Article VI, Section 4: STRIKE ENTIRE SUBSECTION  B

B. All donation requests shall be submitted by a member in good standing of Ed Brauner Post 307 of the American Legion and said member shall be responsible to provide completed application form and needed documentation for each request.


   a. A donation request of up to $300.00 (three hundred dollars) shall be allowed at a regular meeting for consideration by members present for approval, amendment or rejection by vote of membership.


   b. Each donation of more than $300.00 (three hundred dollars) shall require a completed Donation Request Form and needed documentation prior to consideration by Post Executive Committee at its next regularly scheduled meeting.


Article VI, Section 4: INSERT NEW SUBSECTION  B

B. Any donation request, whether received in the mail or in person, exceeding $300 (three hundred dollars), shall require a sponsoring post member, in good standing, to submit a completed Donation Request Form with the organization’s Tax I.D. Number, tax form 990, mailing address and any supporting information explaining the reason why the donation request is being made and how the donation shall be used. If the form is not completed properly, the form will be returned to the sponsor, and the request will be denied until a completed form is received. The donation request will be reviewed by the Finance Committee, which will make a recommendation of the donation amount, not to exceed the amount requested, but which may be lowered. If the Finance Committee rejects the request, it will still be presented to the Executive Committee for their review and vote. The Executive Committee has the final decision on all donation requests.

Article VI, Section 4: MODIFY SUBSECTION  C AS FOLLOWS

C. The amount of a post donation shall be determined by the Executive Committee. and recommendation of same to members for approval or rejection. The dollar amount approved shall not be higher than the original amount requested.

Article VI, Section 4: ADD NEW SUBSECTION  D

D. The sponsoring member will be notified of the Executive Committee’s decision. Any donation request approved by the Executive Committee shall be presented to the membership at the next scheduled post meeting for their approval. A simple majority of the members present must vote to approve any donation. The members cannot change the donation amount approved by the Executive Committee.

Article VI, Section 4: RENUMBER CURRENT SUBSECTION  D  AS  E AND INSERT ADDITIONAL LANGUAGE; STRIKE CURRENT SUBSECTION  E

D. E. A donation request for any group, person or organization, other than American Legion Programs, shall be limited to one request per fiscal year. Only one donation request per Post member per fiscal year shall be accepted.


E. The reason for request and how said donation shall be used will be required on form prior to consideration.

Article VI, Section 4: STRIKE CURRENT SUBSECTION  G

G. No monies shall be disbursed for any donation until a taxpayer ID number and mailing address is provided to the Post.


Article VI, Section 4: INSERT NEW SUBSECTION  G

G. A motion to provide a donation of up to $300 (three hundred dollars) shall be allowed at a Post 307 general membership meeting for consideration by the members present. The motion can be approved by a majority of the members present or can be amended or rejected. If approved the amount cannot exceed. $300. Appropriate documentation, receipts, tax information, and mailing address shall be required prior to check transmittal.

H. It is the intention of Post 307 to financially support local organizations who assist veterans and their families who live in our community.

Article XII

Voting Restrictions

No voting member of the Post 307 Corporation Board shall hold a voting position on the Post 307 Executive Committee with the exception of the current Post Commander.

Article XII, Section 1

Section 1. These bylaws may be amended at any regular post meeting by a vote of two-thirds of the members of said post attending such meeting; provided, that the proposed amendment shall have been submitted in writing and read at the next preceding regular meeting of said post; and provided, further, that written notice shall have been given to all members at least ten (10) days in advance of the date when such amendment is to be voted upon, notifying said members that at such meeting a proposal to amend the bylaws is to be voted upon.

Article II, Section 2: MODIFY AS FOLLOWS

Section 2. The executive committee shall consist of: four (4) elected members in addition to the officers of the post. The four elected members of the executive committee and the Commander, 1st Vice Commander, 2nd Vice Commander, 3rd Vice Commander,   Sergeant-at-Arms, and two (2) color bearers shall be elected annually not more than forty-five (45) days nor less than ten (10} days preceding the department convention and shall be installed into office at the first meeting following the convention. All elections of officers for contested positions shall be by ballot and the candidate or candidates receiving a majority of the votes cast shall be elected. Elected members of the executive committee and color bearers shall be elected by a plurality of votes cast. When candidates for office, other than executive committee or color bearers, do not receive a majority of the votes cast, a runoff election shall be held until a candidate, or candidates receive a majority of the votes cast. The executive committee positions appointed, or assigned to elected executive committee members are adjutant, finance officer, historian, chaplain, judge advocate, and service officer.

Article III, Section 2: MODIFY AS FOLLOWS

Section 2. The Post Executive Committee shall hire such employees as may be necessary; shall authorize and approve all expenditures the annual budget, approve all expenditures that exceed the total budget; shall require adequate bonds from all persons having custody of Post funds including but not limited to Commander, Adjutant and Finance Officer; shall hear the reports of post committee chairmen; and generally shall have charge of and be responsible for the management of the affairs of this post.

Article IV, Section 1A: MODIFY AS FOLLOWS

Section 1A. Duties of Post Commander. It shall be the duty of the Post Commander to preside at all meetings of the post and to have general supervision over the business and affairs of the post, and such officer shall be the chief executive officer of the post. He shall approve all orders directing the disbursement of funds and shall make an annual report covering the business of the Post for the year, and recommendations for the ensuing year, which shall be read at the annual meeting and a copy thereof immediately forwarded to the Departmental Adjutant. He shall be responsible for presenting the new annual budget to the corporation board at least sixty (60) days prior to the start of the new fiscal year. He shall perform such other duties as directed by the Post.

Article IV, Section 7: MODIFY AS FOLLOWS

Section 7. Duties of the Sergeant-at- Arms. The sergeant-at-arms shall preserve order at all meetings, shall coordinate the reservations for all Post parties, as well as have a committee who helps check in attendees at all Post functions. and He shall perform such other duties as may be from time to time assigned to him by the post executive committee.

Article IV, Section 9: MODIFY AS FOLLOWS

Section 9. Duties of Judge Advocate. The judge advocate shall advise Post Executive Committee and membership on all legal matters including instructions and interpreting of Post Constitution and Bylaws and Roberts’ Rules of Order   and shall perform such other duties as are usually incident to the office.

Article IV, Section 10: MODIFY AS FOLLOWS

Section 10. Duties of Service Officer. The post service officer is responsible for bringing to the attention of all veterans and their dependents the rights granted to them by law. the U.S government that benefit veterans.

Article VI, Section 1: MODIFY AS FOLLOWS

Section 1. The Post Commander, immediately upon taking office each year, shall appoint may assign the following positions to elected officers or may assign these roles to additional appointees: an adjutant, a finance officer, a historian, a chaplain, judge advocate, and service officer and committees deemed necessary in the best interest of the post including the following standing committees:

Article VIII, Section 1: STRIKE LAST SENTENCE

Section 1. The regular meeting of this post shall be held at the location designated by post officers, on the fourth Thursday of each month, at which may be transacted such business as may properly be brought up for action; such meeting may be converted into entertainment meetings, as may be deemed advisable by the officers of the post. The November meeting shall be re-scheduled to the third Thursday of November due to Thanksgiving.
